  • Good Faith Statement: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  • Statement of Perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Upon receipt of a valid and complete notice, Carstgud reserves the right to take expeditious action, which may include removing or disabling access to the allegedly infringing material from our catalog.

2. Counter-Notice Procedure

If you believe that your product listing was removed (or access was disabled) by mistake or misidentification, you may submit a Counter-Notice to our Designated Copyright Agent. Your Counter-Notice must include:

  • Your physical or electronic signature.

  • Identification of the material that has been removed or disabled and the location (URL) at which the material appeared before it was removed.

  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.

  • Jurisdiction Consent: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (if in the US), or the courts in North Carolina, and that you will accept service of process from the person who provided the original infringement notification.

3. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Carstgud has adopted a strict policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of suppliers or manufacturing partners who are deemed to be repeat infringers of intellectual property rights.
